2. PURPOSE

This Legal Notice governs access to and use of the website base4bio.com (hereinafter, “the Portal”), through which BASE4 provides information about its multi-omics analysis platform and allows users to purchase its services under the conditions described in the Terms of Use and Purchase, a separate document to which this Legal Notice refers.

BASE4 designs, develops and markets biological analysis services based on multi-omics technology (transcriptomics and genetics), using a blood sample, for wellbeing and prevention purposes. The services offered by BASE4 are for information purposes and do not constitute a medical diagnosis.

3. USERS AND CONDITIONS OF ACCESS AND USE

Access to the Portal is free of charge, except for services that require purchase, the specific conditions for which are set out in the DTC Terms of Use and Purchase.

Browsing the Portal confers the status of User and entails acceptance of all the conditions contained in this Legal Notice from the moment browsing begins.

The User undertakes to use the Portal appropriately and lawfully and to refrain from:

Using the Portal for purposes or with effects that are unlawful, illegal, contrary to this Legal Notice, harmful to the rights and interests of third parties, or that may in any way damage, disable, overload, impair or prevent the normal use of the Portal.
Introducing or spreading computer viruses or any other physical or logical system capable of causing damage to the systems of BASE4, its providers or third parties.
Attempting to access, use and/or manipulate the data of BASE4, third-party providers and other Users without authorisation.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content on the Portal (texts, images, trademarks, logos, design, structure, source code and other elements) is owned by BASE4 or by third parties that have authorised its use, and is protected by intellectual and industrial property legislation (Royal Legislative Decree 1/1996, the Consolidated Text of the Intellectual Property Law, and applicable trademark legislation).

The reproduction, distribution, communication to the public, transformation or any other form of exploitation, in whole or in part, of the Portal’s content is prohibited without BASE4’s express written authorisation, except for the User’s personal and private use.

5. EXCLUSION OF WARRANTIES AND LIABILITY

BASE4 does not guarantee the availability or continuity of the Portal’s operation and accepts no liability for any loss or damage that may arise from:

The lack of availability or continuity of the Portal’s operation, or its lack of usefulness.
The presence of viruses or malicious or harmful software in the content.
Unlawful, negligent or fraudulent use by Users, or use contrary to this Legal Notice.
The lack of lawfulness, quality, reliability, usefulness or availability of services provided by third parties and made available to Users on the Portal.

The content of the Portal is for information purposes only. This analysis does not constitute a medical diagnosis, is not classified as an in vitro diagnostic medical device (Regulation (EU) 2017/746) and does not replace assessment by a healthcare professional. Results must always be interpreted together with BASE4’s medical team or the User’s own doctor.

6. LINKS

If the Portal includes links or hyperlinks to other websites, BASE4 will exercise no control over those sites or their content. Under no circumstances will BASE4 accept liability for the content of any link to a third-party website.

7. PERSONAL DATA PROTECTION

The processing of Users’ personal data is governed by the Portal’s Privacy Policy, available at this link, which forms an integral part of this Legal Notice for these purposes. In the event of any inconsistency between the two documents regarding data protection, the Privacy Policy will prevail.

8. COOKIE POLICY

The Portal uses first-party cookies and, where applicable, third-party cookies for its proper operation and, where appropriate, for analytical purposes. Detailed information about the cookies used, their purpose and how to configure or reject them is available in the Cookie Policy at this link

9. APPLICABLE LAW AND JURISDICTION

These conditions are governed by Spanish law. For the resolution of any dispute arising from access to or use of the Portal, and without prejudice to any rights the User may have as a consumer or to the rules on jurisdiction applicable under Article 90.2 of the Consolidated Text of the General Law for the Protection of Consumers and Users, BASE4 and the User submit to the courts and tribunals of the User’s place of residence, in accordance with consumer protection legislation.

10. COMPLAINT FORMS

In accordance with consumer protection legislation in Catalonia, BASE4 makes official complaint forms available to Users who qualify as consumers. They may be requested by contacting hello@base4bio.com.

11. AMENDMENTS

BASE4 reserves the right to amend this Legal Notice at any time. The version published at the time of access to the Portal will apply. The date of the last update appears at the beginning of this document.
